Looper Strap Weights Pty Ltd (ABN 47 625 200 464) (LSW) owns and operates the website at www.loadlooper.com.au (Website) and supplies the product(s) advertised for sale on the Website under the LOAD LOOPER TM trademark (Product).
These terms and conditions (Terms) apply to a person who visits the Website and/or places an order on or via the Website for one or more Products (You).1. Orders
You may offer to purchase Products from LSW by placing an order on the Website. An order is not binding on LSW unless and until LSW has notified You by email that it has accepted Your order (Your Confirmed Order).2. Pricing
The price(s) for the Product(s) will be published on the Website (Prices). LSW may
update or vary any Prices in its discretion from time to time.3. Taxes
Unless the Website provides otherwise, all Prices are exclusive of applicable taxes and levies, including without limitation, GST (as defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) (Taxes). You agree that You must pay LSW an amount equal to the applicable Taxes for Your Confirmed Order.4. Payment
You agree that LSW or it’s consignee may debit Your credit or debit card for the total cost of the Products specified in Your Confirmed Order in Australian Dollars (being the applicable Price multiple by the number of Products specified therein plus all applicable Taxes and shipping and freight costs) (Your Confirmed Order Total). LSW will send You a tax receipt by email once Your credit or debit card has been successfully debited for Your Confirmed Order Total. If LSW provides a refund to You for any reason, LSW will refund the amount to your credit or debit card and notify You of the same by email.5. Delivery
Your Confirmed Order will be shipped and delivered to You by third parties from LSW’s premises or its agent’s or contractor’s premises (LSW Premises). To the extent permitted by law, You agree that LSW will not be liable to You for any loss or damage which You suffer or incur as a result of any delay or failure in delivery of Your Confirmed Order (or any part thereof), or for any additional costs, fees or charges which You incur in connection with the delivery of Your Confirmed Order (or part thereof) once the Products specified therein have left the LSW Premises.6. Titleandrisk
Title in and to the Products specified in Your Confirmed Order will only transfer to You once LSW has received payment in full in cleared funds for Your Confirmed Order Total and the Products have been collected from the LSW Premises for delivery to You (whichever is later). Risk in the Products specified in Your Confirmed Order will pass to You upon the collection of the Products from the LSW Premises. You agree that LSW will not be liable for any loss or damage caused to the Products during shipping and transit.7. PROHIBITIONSANDINDEMNITY

YOU MUST COMPLY WITH ALL INSTRUCTIONS AND DIRECTIONS PROVIDED ON OR IN THE FOREGOING AT ALL TIMES, INCLUDING ALL SAFETY AND USE GUIDELINES AND INSTRUCTIONS ON CORRECT THROWING TECHNIQUES. YOU ACKNOWLEDGE AND AGREE THAT IF YOU FAIL TO DO SO OR USE A PRODUCT IN A CARELESS MANNER YOU COULD CAUSE PERSONAL INJURY, DEATH AND/OR PROPERTY DAMAGE. If any dispute arises between LSW and You in relation to these Terms which is not resolved within 30 days of one party notifying the other party of the dispute, the dispute will be referred to private mediation by a mediator agreed by the parties, or failing agreement within 7 days, by a mediator selected by the Chair of the Resolution Institute (www.resolution.institute). The parties will share the costs of the mediation equally. The Resolution Institute Mediation Rules form part of these Terms. This clause does not prevent a party from seeking urgent interlocutory relief in a court of competent jurisdiction.13. Entire agreement
These Terms represent the entire agreement between LSW and You in relation to the
supply of Products to You.14. Variation
You agree that LSW may update these Terms from time to time by publishing any updated or amended version on the Website. You agree to be bound by the version of these Terms as published on the Website at the time Your order is accepted by LSW and becomes Your Confirmed Order.15. Severability
If any part of these Terms is or becomes void or unenforceable that part is severed so that all parts which are not void or unenforceable remain in full force and effect and are unaffected by the severance.16. Governing law
